• When working with Who’s Julian? Films, we aim to provide the utmost convenience, professionalism, and quality.
  • To ensure a smooth and enjoyable experience for all parties, the following Terms & Conditions outline how we work, what you can expect from us, and what we require from our clients.
  • By engaging our services, you agree to these terms.
• 1. Services
  • 'Who’s Julian? Films' provides freelance video production services, which may include (but are not limited to): pre-production planning, filming, directing, cinematography, lighting, audio recording, editing, colour grading, and delivery of final video content.
  • Specific services, deliverables, timelines, and fees will be agreed upon in writing prior to commencement.
• 2. Quotes & Booking
  • All quotes are provided in Australian Dollars (AUD) unless otherwise stated.
  • Quotes are valid for 14 days from the date issued.
  • A booking is only confirmed once written acceptance of the quote is received and any required deposit is paid.
  • 'Who’s Julian? Films' reserves the right to decline projects that fall outside agreed scope, availability, or capability.
• 3. Payment Terms
  • A deposit (typically 30–50%) may be required to secure a booking.
  • The remaining balance is due upon completion of the project or upon delivery of the final files, unless otherwise agreed in writing.
  • Invoices must be paid within 7 days of issue.
  • Late payments may incur additional fees or result in withholding of final deliverables until payment is received.
• 4. Cancellations & Rescheduling
  • Cancellations made more than 7 days prior to the shoot date may receive a refund of the deposit (minus any costs already incurred).
  • Cancellations within 7 days of the shoot date may forfeit the deposit.
  • Rescheduling is subject to availability and may incur additional costs.
  • 'Who’s Julian? Films' is not responsible for delays caused by weather, illness, equipment failure beyond reasonable control, or other unforeseen circumstances, though best efforts will be made to reschedule.
• 5. Client Responsibilities
  • The client agrees to:
  • Provide accurate project details, creative direction, and reference materials where required.
  • Ensure access to locations, talent, permissions, and releases prior to filming.
  • Obtain all necessary permits, approvals, and clearances unless otherwise agreed.
  • Ensure a safe working environment during production.
• 6. Creative Direction & Revisions
  • Creative decisions are guided by the agreed brief.
  • One to two rounds of reasonable revisions are typically included (as specified in the quote).
  • Additional revisions outside the agreed scope may incur extra charges.
  • Major creative changes requested after production has commenced may require a revised quote.
• 7. Delivery & Turnaround
  • Delivery timelines will be discussed and agreed upon prior to the project start.
  • Turnaround times may vary depending on project scope and client feedback response times.
  • Final files are typically delivered digitally unless otherwise specified.
• 8. Ownership & Usage Rights
  • 'Who’s Julian? Films' retains ownership of all raw footage unless otherwise agreed in writing.
  • Upon full payment, the client is granted a licence to use the final delivered video for agreed purposes (e.g. marketing, social media, website).
  • Usage beyond the agreed purpose (e.g. paid advertising, broadcast, resale) may require additional licensing fees.
  • 'Who’s Julian? Films' reserves the right to use completed projects for portfolio, website, and promotional purposes unless the client requests otherwise in writing.
• 9. Music, Assets & Third-Party Content
  • Licensed music and assets will be used where applicable.
  • Costs for music licensing or stock assets may be passed on to the client unless included in the quote.
  • The client is responsible for ensuring they have rights to any materials they provide.
• 10. Liability
  • 'Who’s Julian? Films' will take reasonable care during production but is not liable for indirect or consequential losses.
  • Liability is limited to the total amount paid for the services.
  • The client indemnifies 'Who’s Julian? Films' against claims arising from materials or instructions supplied by the client.
• 11. Confidentiality
  • Any confidential information shared during the project will be kept confidential unless disclosure is required by law or agreed otherwise.
• 12. Termination
  • Either party may terminate the agreement in writing if the other party breaches these Terms & Conditions. Fees for work completed up to the termination date remain payable.
• 13. Governing Law
  • These Terms & Conditions are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of Australian courts.
• 14. Acceptance
  • By engaging 'Who’s Julian? Films', you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
